1. 暂停法庭程序的时间会否影响调解的最后期限? 

 

Chief Justice Beasley issued an Order on April 13, 2020, 延长本应在行政命令所涵盖的期限内提交申请或采取行动的最后期限, 这样，如果在6月1日营业结束前完成，这些行为将被视为及时. 2. Can a 中介 hold a mediation in his or her own office upon consent of 当事人? 

 

If the attorneys, 方, 和 中介 want to meet in person to hold a mediation, they may NOT do so until Chief Justice Beasley’s Order of April 2, 2020年到期. If the order is extended, the in-person mediation may not take place until all subsequent orders 到期.

4. Should we still send an order to mediate to 当事人?

 

是的. Filings are still being accepted by the clerk. If a case is filed in superior court 和 it is eligible for mediation, 您应继续向双方发送调解令(AOC-CV-811).  In Family Financial matters, 如果当地规则规定在安排和发现会议之前发送调解令, you should send 当事人 an Order to Mediate (AOC-CV-824) for FFS matters. 然而, 如果贵地区在排期和发现会议上向各方提供调解令，而会议已继续进行, 那么在会议重新安排时，应向各方提供调解令. 

 

5. Is there an NCAOC form to extend the mediated settlement conference deadline?

 

是的，表格AOC-DRC-19可用于延长MSC和FFS事项的截止日期.  The motion to extend the deadline may be initiated by the court, with the consent of 各方, or by the 中介.  

 

6. If the court grants a motion for extension of time to complete mediation, may the new deadline be extended beyond what is in the rules or statute? 

 

MSC规则3(b)规定，调解截止日期应为调解命令发出后120至180天. FFS规则3(b)规定，调解截止日期不得超过命令调解之日起150天.  These are the original deadlines.  Once the matter has a deadline, 当事人, 中介, 或者只要不干扰其他诉讼程序，法官也可以继续进行MSC和FFS事项.  因此, the MSC or FFS rules do not limit the extension deadline for a mediation.  只要审判日期改变了，完成调解的截止日期也可以改变.  

 

7. 已经立案但尚未被责令调解的案件，可以亲自调解吗?

Under Chief Justice Beasley’s order issued April 13, 2020, 所有在3月16日或之后以及6月1日之前提交的申请，如果在6月1日之前提交，则视为及时, 2020.  因此, 在这段时间内指定调解员将不需要法院指定调解员，除非在6月1日营业结束前没有向书记员提交指定.  请在首席大法官比斯利(Beasley)于4月13日发布命令之前，不要指派法院指定的调解人处理任何事项, 2020, 和 any subsequent orders, 到期.  

 

9. Can the court order the mediation to be held remotely?

 

 No, the court may not order the mediation to be held remotely by its own motion. Pursuant to Chief Justice Beasley’s 4月2日 order, 各方 must consent for the mediation to be held remotely.  

 

Under Rule 4 of the MSC 和 FFS Rules, 经各方同意或法院命令，可豁免亲身出席的规定, 根据一方当事人的动议并通知调解员及所有当事人和被要求出席的人. 《皇冠足彩网》没有规定法院可以自行提出放弃出庭的动议.
